Minutes of March Meeting of HOA Board
March 13, 2012
Present: Corey Bennett, Jessica Dempsey, Janet Prendergast, Scott Woller, and Erika Klauss. Guests present were: Officer Rick Bectel, Officer Zeb Campbell and homeowner, Marcus Moore.
Meeting called to order at 6:30 p.m.
Officer Bectel and Officer Campbell were invited to our meeting to clarify for the Board the City of Cheney’s position on what they will respond to in our neighborhood and what they cannot, in their eyes, respond to. To summarize, they said they cannot enforce our 20 mph speed limit, driving up around the speed bumps, or whether the people in the Orchards stop at the stop signs unless they see them do it; they will enforce all infractions of criminal law; they will enforce infractions of parking in our Fire Lanes and in front of fire hydrants; they said that under RCW 46.61.570 (parking on sidewalks), that they do not have the authority to ticket cars parked on the sidewalk or parked so they block the sidewalk; that the Association would have to address those two issues. They will investigate theft, assault, and noise disturbance. They will give a warning first and then use further means of enforcement if they have subsequent calls on the same residence. They will do, as time allows for them, periodic checks of excessive speed in the Orchards.
The Board then discussed with them the complaints that they have received from one of our resident homeowners to individuals of the Board, to this person’s neighbors, and to the City of Cheney itself. Within the last month members of the Board have been contacted by him and have tried to resolve legitimate issues, but just within the last 30 days, four letters of various complaints have been mailed to us, and the Police and Code Enforcement Officers have also been called many times. We discussed his complaints and all agreed that most of them were not legitimate issues, and that his further harassment of his neighbors is a criminal act and that the police will talk with him regarding that issue.
The Board also agreed that a letter acknowledging his many letters and complaints will be sent from the Board within a week of this meeting.
Secretary’s Report: It was moved and seconded that the minutes of the February 13th meeting be accepted as written; passed unanimously.
Treasurer’s Report: The Income/Expense Report for February was presented. Income of $12,365 from dues and expenses of $4,376.01.
Bills to be paid: City of Cheney $ 77.11
Neighborhood Lawn and Tree $1,208.41
Banner Bank-Safe Dep Box $ 40.00
It was moved and seconded that we pay these bill, unanimously passed.
Erika said that we have 9 homeowners who have not paid their dues; and three on payment plans with the HOA. Janet asked Erika to send her any changes of address so she can update her records.
Janet asked Erika if she planned on sending the unpaid homeowners to collection the first part of April. She said that she would like to wait awhile and send them another statement. It was suggested that she might want to use the Automated Accounts stickers on her next dues statement.
Old Business: Jessica has talked with the rental homes that were complained about asking them all to be more careful where they park their vehicles. She will continue to interface with this homeowner when she can make a difference in addressing his complaints.
Gary Grimmett has replaced the stop sign that was knocked over at the Betz Street entrance.
Janet reported that she has gotten a bid from AAG Agency giving us a new, lower quote for D&O Liability Insurance, and that they asked to see our current coverage on General Liability coverage. They feel that they can get us better pricing on both of these policies. A note has been put in the file for next January to contact AAG and get those quotations.
New Business:
Janet was asked to contact Half-Moon Construction and get on their schedule for work to be done on the drain on the corner of Meadow Glen and Silverthorn. She was also asked to contact Specialty Asphalt and get on their schedule to have the centers cut out of three more speed bumps on Meadow Glen, and to get a quotation for replacement fencing in the common area at the cul-de-sac on Thistle Creek Lane. She will also order six new Fire Lane signs to replace those in the Orchards which have faded so much they cannot be read anymore. She was also asked to re-send the To-Do List to the Board members so that we can schedule maintenance work to be done this spring and summer.
A new signature card from Banner Bank was passed around for Board signatures.
The next meeting of the Homeowner’s Board will be April 10th at 6:30 pm at Janet Prendergast’s house.
